O&#8217;Rourke<\/a>.<\/p>\n<p>Real brief. Really hysterical. The topic: Whether a state can criminalize (get this!) <i>lying about candidates during political campaigns<\/i>.<\/p>\n<p><a href=\"http:\/\/object.cato.org\/sites\/cato.org\/files\/pubs\/pdf\/sba-list-merits-filed-brief.pdf\" target=\"_blank\">The brief<\/a> opens:<\/p>\n<blockquote><p>\n<center><b>INTRODUCTION AND<br \/>\nSUMMARY OF ARGUMENT<\/b><\/center><\/p>\n<p>\u201cI am not a crook.\u201d<\/p>\n<p>\u201cRead my lips: no new taxes!\u201d<\/p>\n<p>\u201cI did not have sexual relations with that<br \/>\nwoman.\u201d<\/p>\n<p>\u201cMission accomplished.\u201d<\/p>\n<p>\u201cIf you like your healthcare plan, you can keep it.\u201d<\/p>\n<p>While George Washington may have been<br \/>\nincapable of telling a lie, his successors have not had<br \/>\nthe same integrity. The campaign promise (and its<br \/>\nsubsequent violation), as well as disparaging<br \/>\nstatements about one\u2019s opponent (whether true,<br \/>\nmostly true, mostly not true, or entirely fantastic),<br \/>\nare cornerstones of American democracy. Indeed,<br \/>\nmocking and satire are as old as America, and if this<br \/>\nCourt doesn\u2019t believe amici, it can ask Thomas<br \/>\nJefferson, \u201cthe son of a half-breed squaw, sired by a<br \/>\nVirginia mulatto father.\u201d Or perhaps it should ponder, as Grover Cleveland was forced to, \u201cMa, ma,<br \/>\nwhere\u2019s my pa?\u201d<\/p>\n<p>In modern times, \u201ctruthiness\u201d \u2014 a \u201ctruth\u201d asserted<br \/>\n\u201cfrom the gut\u201d or because it \u201cfeels right,\u201d without<br \/>\nregard to evidence or logic 5 \u2014is also a key part of<br \/>\npolitical discourse. It is difficult to imagine life<br \/>\nwithout it, and our political discourse is weakened by<br \/>\nOrwellian laws that try to prohibit it. <\/p><\/blockquote>\n<p>Just gets better from there.
