Nice to see that jury verdict in Seattle, but I doubt that it will stand on appeal (and it will be appealed). The prosecutor had previously determined that the shooting was “justified” (so there was no criminal trial; this was a civil one), but the federal courts have broadened the doctrine of “qualified immunity” so much that I expect the appeals court to vacate the verdict and order the case dismissed. Which is truly a shame; “qualified immunity” is entirely court-made doctrine, with little basis in law, but it has been applied in some pretty egregious cases. If they have any sense the family will agree to a lesser settlement before any appeal can be heard.
